Trademark Overview of Registration Process & Fees
The Comprehensive Search A preliminary search at the United States Patent and Trademark Office (USPTO) is just that, preliminary. The USPTO itself includes a "WARNING" in red text, not to rely on a preliminary search. It should only be used to give a quick answer as to whether the trademark may be available. If a preliminary search turns up nothing then a comprehensive search is done. It is important to note that a comprehensive search should be done. Courts have ruled that even where a trademark registration has been granted, any trademark infringement that arises out of that registration, will be considered a bad faith, willful infringement, if a full, comprehensive search isn't conducted. That finding of willful infringement results in increased liability and the severest of damages. A full, comprehensive search is conducted by an established, outside, reliable search company. That search includes many sources for existing trademarks that the USPTO database doesn't. For example, searches are made of trademark records from the 50 states, common law sources such as the Web common law, Internet domain names, 21 million business names licensed from Dun & Bradstreet and American Business Information, Inc., as well as the Gale Group. One should think long and hard before registering a trademark without conducting a full, comprehensive search. It is not a wise decision to expose oneself to the risks of a willful infringement claim for not having the protection of a comprehensive search. Additionally, you are put at risk of losing your established trademark brand. The comprehensive search company fee is $550. Examination and Analysis of the Comprehensive Search Depending on the trademark name searched for, the comprehensive search company may return documents, to our law firm for examination and analysis, in excess of 100 pages. A flat legal fee for
examination and analysis of the comprehensive trademark search is $897
for up to 100 pages. Depending on the trademark the
comprehensive search company may return documents in excess of 100
pages. An additional fee of $250 will be billed for every 50 page
segment above that. Note
that these fees are in addition to other fees. Trademark Application Filing and Representation Through the Trademark Process The trademark process generally takes between one and two years to complete. During that time you are required to respond to any questions and legal issues raised by the examiner, referred to as Office Actions. In many instances, you must respond with legal citations and cases. Rather than billing hourly fees for legal representation over the one to two years required for representation, we have instituted a flat one time fee. The fee for applying for your trademark and representation through the trademark process, taking approximately one to two years, responding to the various United States Patent and Trademark Office correspondences, etc., is a one time flat fee of $1500. This does not include any appeal process. While your trademark application is pending
you should use the symbol ™ at the end of your trademark name. Once
the registration is granted you are permitted to use the symbol ® at the end

Ex Parte Appeals to the Trademark Trial and Appeal Board (TTAB) are similar to filing an appeal in an Appellate Court. There are strict rules governing the procedure and appeal briefs are filed from both sides.
